Duty To Dispense: Overcoming Uncertainty, Doubt and Fear

Description
The community pharmacist has a professional responsibility to dispense medications when the medications have been legally prescribed and therapeutically appropriate for the condition being treated. Pharmacists who deny or withhold medication may be held liable for negative consequences of their actions. Often pharmacists can become confused with the professional responsibility to ensure access to medications, especially opioid analgesics; and the legal-regulatory duty to prevent diversion of controlled substances. Underlying the behavior of pharmacists in many instances is the fear of burglary, robbery, or forgery if it is known among criminal elements that opioid analgesics are routinely stocked in their pharmacy. This fear can be so great that a recent study of pharmacies in select neighborhoods reported that 75% of pharmacies did not have sufficient supplies of opioids to treat severe pain. To respond to the need to create a safer environment for pharmacists, a national clearinghouse has recently been launched to assist in the sharing and dissemination of information to law enforcement personnel, as well as proactively assisting pharmacists in reducing the potential for crime.

Educational Objectives
Upon completion of this activity, participants should be better able to:

  1. Understand the rational and therapeutic options in treating patients with persistent pain.
  2. Discuss regulatory standards and professional responsibilities in the context of access for legitimate patients to opioid analgesics.
  3. Cite three examples where pharmacists were challenged in court for their decisions regarding patients with prescriptions for schedule II Controlled Substances.
  4. Describe barriers to the ability of law enforcement personnel to coordinate investigations of pharmacy crime in overlapping jurisdictions.
  5. Identify three steps pharmacists can take to decrease the opportunity for being victim of pharmacy crime as well as to proactively prevent loss.

Credit Designation
A score of 70 percent is required to successfully complete the CE quiz. You will have two opportunities to achieve a passing score.

The Statement of Credit should be printed upon receipt; a duplicate copy will be available in the participant's online transcript for further viewing. Individuals must complete this program by October 19, 2006 to receive credit.

NCPA is approved by the Accreditation Council for Pharmacy Education (ACPE) as a provider of continuing pharmacy education. This program will provide 2.0 contact hours (.2 CEUs) of continuing pharmaceutical education credit under the number 207-000-03-114-H04.
